We, homii B.V., respect your privacy. This privacy policy helps you understand how we handle your personal information when you use our Services (as defined in our User Agreement) and our website (www.homii.nl) and what your privacy rights are.

1. Important information and who we are

1.1

This privacy policy is to provide you with information about how homii collects and processes your personal data through your use of our Service , including the data you provide through our website when you sign up for our newsletter or create an account.

homii B.V. (located at Fred Roekestraat 115, 1076 EE in Amsterdam) is the controller of and responsible for your personal data ("we", "us" or "our" in this privacy policy).

Our privacy policy is reviewed regularly. If we make significant changes, we will notify you by email or by a message in our app.

It is important that the personal information we hold about you is accurate and current. Therefore, we ask that you update your account information if your personal information changes.

Our Services and our website may contain links to third-party websites, plug-ins and applications. By clicking on or activating those links, third parties may collect or share data about you. We have no control over these third-party websites and are not responsible for how they process personal data. When you leave our app or website, we encourage you to read the privacy policy of each website you visit.

2. Who we collect personal information from

2.1

Personal information is any information about an individual that identifies that individual.

2.2

We collect personal data from anyone who has been in contact with us (such as visitors to our website, people who sign up for the newsletter, and people who use our Services). For example, when you visit our website, create an account for our Services, or when you contact us, you directly share personal data with us.

We also collect personal data that we receive from third parties. We receive automated data from the supplier that provides the metering services for the heating of your building and data from the party with whom homii has entered into an agreement for your use of our Services (usually your landlord or the association of owners of which you are a member of). In addition, we may receive data from third parties when you create an account through a social media provider such as Facebook or Google+. We only collect personal data through third parties if you have given these third parties permission to provide your personal data to us.

2.4

In order for us to provide the Service we are required to retrieve current and historical heating and billing information of your apartment from either your landlord, the association of owners or the company that provides the metering services. This includes, but is not limited to, measured heating in GJ or units (as indicated by radiator meters), past invoices of heating cost and historical and current advance payments.

2.5

If you rent your apartment and make use of our Services, it is important to note that we are also entitled to share the data we collect and generate with regards to your apartment with your landlord.

2.6

Further, during your interaction with our website, we will automatically collect certain technical data (such as your IP address, your login credentials, browser type and version, operating system and platform, and other technology on the devices you use to access our website). We collect this technical data through the use of cookies, server logs and other similar technologies. We may also receive technical data about you when you visit other websites that use our cookies.

3. The personal data we process and the purpose of the processing

3.1

We will not process your personal data for purposes other than those specified below, unless we reasonably believe that we may use it for another reason and that such reason is compatible with the original purpose. If we intend to process your personal data for purposes other than those listed above, we will notify you of those purposes before or at the time we collect your personal data.

3.2

Your personal data may be processed on the basis of your consent. In this case, we will always ensure that we have received your free, specific, informed and unambiguous consent. You have the right to withdraw your consent at any time by sending an email to info@homii.app.

3.3

Your personal data may additionally be processed on the basis of legitimate interests pursued by us, for example for administrative purposes or for research and development purposes. This legal basis applies, for example, when we process your personal data to communicate with you, to improve the quality of our services, to provide you with marketing information (including direct marketing), and to manage our business operations and IT infrastructure. 

3.4

Your personal data may further be processed if necessary to comply with a legal obligation to which we are subject.

3.5

To create an account, we need the following personal data from you:

  • your full name; and
  • e-mail address.

In addition, you may choose to add the following personal data (but it is not required):

  • phone number

Once you create an account, we store the preferences you have specified in your account. The personal data stored in your account will be kept for 6 months after the termination of the agreement to use our Services, unless you request us to delete your account.

3.6

As part of our Service, we collect your given full name, e-mail address, address and, if applicable, your phone number. In addition, we collect historical heating and billing information with regards to your apartment. Finally, we generate a prediction of your heat consumption for the given year. This data is stored in our database and shown in our user app (for you) and admin dashboard (for your landlord or association of owners). This data is stored during the period that you use our Services, and after that, for a maximum period of three (3) years. We use that data for internal purposes such as analysis and process improvements and for any mandatory reporting obligations we might have.

3.7

You can contact us with any of your questions about our Services. Depending on how you contact us, we will process your email address (and email content) or phone number. Further, we may use your account information to communicate with you about our policies and terms and conditions.

3.8

Your written requests and our notes about your contact with us may be useful for future requests. Therefore, we retain this information for as long as you are entitled to use our Services. If you are not entitled to use our Services, your email and/or our notes will be kept for as long as necessary to assist you.

3.9

Our goal is to help you find what you are looking for on our website and to ensure our Service provides the information you need. To do this, our website and our Services need to work properly. Therefore, we collect your IP address, information about your internet browser and information about the operating system settings of the computer or mobile device you use to visit our website or use our Service. Furthermore, our goal is to make our website and our Service as relevant to you as possible by tailoring our website and Service to you. To this end, we collect search and click behavior on our website and our Services from all visitors/users. We use that data to understand generic patterns and use it on an individual level. We have a legitimate interest in this because it allows us to improve our service to you. We do not retain your personal data used for this purpose for longer than 365 days.

3.10

Once you have a homii account we may email you about our services, unless you let us know that you do not wish to receive such information. 

3.11

We will send you our newsletter if you explicitly consent to it. If you are no longer interested in receiving our newsletter, you can unsubscribe through your account or through the unsubscribe option provided in the footer of each newsletter.

3.12

We may use the personal information we hold about you - such as IP addresses and click behavior - for security purposes or to prevent or investigate other unlawful conduct.

3.13

In the event of fraud or unlawful behavior, we will retain all affected data for a period of 2 years after discovery.

4. Disclosure of your personal data to third parties

4.1

We will disclose your personal data only in compliance with applicable data protection laws and only to parties that provide sufficient guarantees for the protection of your data and the realization of your rights as a data subject.

4.2

In providing our services, we use third parties to achieve the above purposes (see above; The personal data we process and the purpose of processing, clause 3). These parties are our data processors. We enter into processor agreements with all data processors and only share personal data with them on a 'need to know' basis and subject to confidentiality and adequate security.

4.3

Data processors we may use are:

  • IT service providers;
  • data storage service provider;
  • other outsourced third-party technical services that assist us in carrying out our business activities;
  • analytical consultants (aggregated data only);
  • research and development organizations (aggregated data only); and/or
  • Other third parties.

4.4

If we buy or sell a business or business assets, we may disclose your personal data to a prospective buyer or seller of such business or business assets. If we or a substantial portion of our business assets are acquired by a third party, your personal data may be disclosed to that third-party purchaser.

4.5

If required by law, we may also disclose your personal data to government, governmental, legal or regulatory authorities and enforcement agencies.

5. Your legal rights

Under certain circumstances, you have the following rights with respect to your personal data. 

  • Request access to your personal data. This allows you to obtain a copy of the personal data we hold about you and to check that we are processing it lawfully.
  • Request correction of the personal data we hold about you. This allows you to have incomplete or inaccurate data we hold about you corrected, although we may need to verify the accuracy of any new data you provide to us.
  • Request deletion of your personal data. This allows you to ask us to delete or remove personal data when there is no good reason why we should continue to process it. You also have the right to ask us to delete or remove your personal data when you have successfully exercised your right to object to processing (see below), when we may have processed your data unlawfully, or when we need to delete your personal data to comply with local law.
  • Object to the processing of your personal data where we are relying on a legitimate interest (or that of a third party) and there is something in your particular situation that makes you want to object to processing on this ground because you consider that it affects your fundamental rights and freedoms. You also have the right to object when we process your personal data for direct marketing purposes. In some cases, we can demonstrate that we have compelling legitimate grounds to process your data that outweigh your rights and freedoms.
  • Request to restrict the processing of your personal data. Allows you to ask us to suspend the processing of your personal data in the following scenarios: (i) when you want us to establish the accuracy of the data, (ii) when our use of the data is unlawful, but you do not want us to delete it, (iii) when you want us to retain the data even if we no longer need it because you need it for the establishment, exercise or defense of legal claims, (iv) you have objected to our use of your data, but we need to verify that we have compelling legitimate grounds to use it.
  • Request to transfer your personal data to you or a third party. We will provide your personal data to you or a third party of your choice in a structured and reusable format. This right only applies to automated information that you have initially given us permission to use or when we have used the information to perform a contract with you.
  • Revoke consent at any time when we rely on the consent to process your personal data. However, this will not affect the lawfulness of the processing carried out before you withdraw your consent. If you withdraw your consent, we may no longer be able to provide you with certain services. We will let you know if this is the case at the time you withdraw your consent.

6. Transfer of your personal data outside the EEA

6.1

We always aim to process your personal data within the European Economic Area (EEA), but in order to achieve one of the purposes mentioned above, it may be necessary to transfer your personal data to countries outside the EEA.

6.2

We will transfer your data to a third party located outside the EEA only after careful review and/or the signing of a specific agreement to ensure that this third party:

  • provides appropriate safeguards regarding the level of protection of your personal data;
  • duly informs the data subject;
  • ensures the enforceability of your rights as a data subject; and
  • provides you with effective legal remedies.

7. Data storage and security

7.1

In general, we will store your personal data no longer than necessary for the performance of our agreement and/or for the fulfillment of any of the other purposes listed above (see above: the personal data we process and the purpose of processing, clause 3). We will regularly check which personal data no longer serves a purpose, in order to delete or otherwise anonymize it.

7.2

We have implemented appropriate security measures to prevent the accidental loss, unauthorized use or access, alteration or disclosure of your personal data. In addition, we restrict access to your personal data to those employees and third parties who have a need to know. They will only process your personal data on our behalf and they are subject to a duty of confidentiality. 

7.3

We have procedures to address (suspected) personal data breaches and will notify you and any applicable regulatory authority of a breach when we are required to do so by law.
